Supreme Court won’t hear Dover’s appeal in Dover Chemical case

DOVER – The Ohio Supreme court will not hear the city’s appeal in its dispute with the Dover Chemical Company.

The two sides are at odds over $1.1 million in electric surcharges the city attempted to levy against the company between 2021 and 2023.

Dover Chemical so far has received more favorable rulings from the lower courts, which ruled the company did not have to pay the surcharge and could sue the city for additional claims.

Dover appealed to the State Supreme Court, but the court this week declined to accept jurisdiction over the case.

The dispute will likely return to Tuscarawas County Common Pleas Court where Judge Elizabeth Thomakos will consider Dover Chemical’s additional claims against the city.
