Dover to appeal court ruling that favored Dover Chemical
DOVER (WJER) (April 24, 2024) – The city is not giving up its fight against Dover Chemical.
City attorneys have filed notice that they will appeal a Common Pleas Court decision that blocks the city from imposing $1.1 million in punitive surcharges against the company.
The legal battle has been ongoing since February 2021 when Dover Chemical sued the city over those surcharges. The company’s attorneys say the city has no right to impose them. The city says the company owes Dover the money for decades of improperly receiving free services and equipment.
Judge Elizabeth Thomakos in early April ruled the city’s surcharge is discriminatory and unenforceable. She returned that $1.1 million to Dover Chemical.
City officials and Council members met in a closed door session with city attorney Delores Garcia last Monday. She filed the notice of appeal five days later. The city has accumulated more than $500,000 in legal costs so far.
